Trial judge did not abuse her discretion because she did not award husband the non-marital portion of his pension for the approximately three years the pension accumulated before he was married; the judge specifically found that the pension would be divided equally because husband alone received benefits from the pension for approximately two years which offset the years that the pension accumulated before he was married.
Ownership Interest
The employee spouse’s pension/Savings benefits were marital property, and the non-employee spouse had an apportionable ownership interest in those benefits; the nature and extent of that apportionable interest was a matter reserved for subsequent judgment by that court and subject to its continuing jurisdiction.
